The other less talked about but important aspect of the appeals court ruling is that it holds that the president is an officer. Why’s that important? 14th Amendment. It’s why the Colorado Supreme Court also banned Trump from their ballot pending appeal. Former far right Associate Justice Antonin Scalia also in an old ruling held that the president is of course an officer as well.
