After Bane breaks his back and the guards take him away and put him in the pit, then they take all his Batman armor and costume off, I'd think they'd find the brace and take it off too.

TDKR pretty much was Nolan's The Dark Knight Returns. Batman returned to Gotham in in TDKR as he did in The Dark Knight Returns.
