The audience does care. That's the point. The Joker is the biggest pop-culture villain ever except for Darth Vader, but definitely the biggest from comics, and he was being played by a break-out A-list controversial star who had rumblings for ages of his performance being oscar worthy early on. That has a ton of box office draw right there.

I'm tempted to say TDKR will still break Avengers despite its $200+ million weekend opening. Either way, I'm fairly confident TDKR will have longer legs.

Because Nolan deserves these records, mindless Avengers action getting the best of the OW isn't going to cut it. We need to show people what real film is, and it would be nice for us to get the OW record anyways, since it's nice to look at TDKR at the top of the list. Avengers is an amazing popcorn flick, but won't get to scratch TDKR any bit.
The fact that you referred to all of the action in Avengers as "mindless"makes me believe that you haven't actually even seen the film. Also, it would take a HUGE marketing effort to give TDKR an OW bigger than that of Avengers. TDKR may be the dramatic end of a trilogy, but Avengers has been built up to with 5 films, gathering fans of 4 different superheros to see a casual movie with terrific WOM. Avengers also appeals to a much younger demographic, and won't be as adult oriented as TDKR probably will be (parents will also be on the look out after the brutality in TDK, despite the rating). Finally, Avengers has the IMAX 3D sales boost- I paid 17 bucks when I saw Avengers, and TDKR's 2D Imax won't cost that much.

All this has me convinced that it would take a miracle for TDKR to pull away Avenger's records. Sorry Batman
Oh I've seen the film. TDKR is going to have a huge marketing effort, have you seen TDK's marketing?

No it doesn't. Look I didn't care about any of those Avengers characters, I didn't care for any of the pre-Avengers movies(Thor, Iron-Man 2, Captain America) except for Iron Man 1 and my wife hadn't seen Thor and didn't like Captain America but we went and saw Avengers anyway. My wife didn't even know half the characters in the movie but she didn't care. She wanted to see Avengers and she enjoyed it. No one or hardly anyone is going to say 'Man I don't know if I want to see TDKR, Bane is in it I don't know who that is'. General audiences don't care as long as it's Batman, the movie is halfway decent(which it will be more than that as we all know) and knowing this is the last of the series. People want to know what will happen with/to Batman, what will Bane do, Catwoman, etc. This movie hasn't even scratched the surface of it's all out promotion yet. With TV spots, more interviews, the 3rd trailer just now in theaters.

However, I think TDKR will come close in both domestic and global gross with Avengers in the end. Neither party will surpass the other by a large margin.

I don't understand why so many people will be "sad" when TDKR doesn't get the record for it's OW. Sure, it would be cool for Nolan's film to earn that record again, but in the end, it all has a near-zero effect on us common folk.

What is "real film" and why do you get to decide what it is? Isn't "quality" really subjective anyways? Isn't that for the general public to decide? The Avengers is silly, yes, but it's very good escapism for the common moviegoer who just wants to forget about the real world for a couple of hours. Isn't that what movies are supposed to be?
