Pines had a single screening in 2012; it wasn't available for anyone outside of those invited to it's Toronto premiere until several months into 2013. It hardly qualifies, and as such wasn't recognized by the Academy. Zero Dark Thirty is a totally different story, for reasons Vader already touched on.

Well, there's a difference between years and weeks, and home video releases and wide releases. I don't think it's a stretch to call it a 2013 release (though I don't personally think of it as such) when the large majority of people didn't see it until 2013.
