I've been over this before but if you pause the hospital scene where the Joker shoots officer Davis , you can see it is of the same kind of non-lethal projectile that fells the shotgun wielding banker in the gut at the beginning of the movie. The Joker's gun you will find upon study that it is more set on shock and awe than on fatality. You have to remember that the air is still contaminated with the scarecrows panic inducing toxin.

I don't think so. First of all Wuertz wasn't considered a cop anymore and there were two cops that were responsible for Harvey in the hospital and both of them get killed.
