It's all relative. TDK > TDKR but TDKR > Les Miz. If Les Miz can get nominated for Best Picture and even win the Globes, then surely TDKR deserves a nod too. She was the best new character in TDKR IMO. Really? Just in terms of character? It was kind of underwritten in comparison to Bane and Blake. Except that it's not ambiguous at all. The script and the official novel make it clear that he's alive.
