Pines had a single screening in 2012; it wasn't available for anyone outside of those invited to it's Toronto premiere until several months into 2013. It hardly qualifies, and as such wasn't recognized by the Academy. Zero Dark Thirty is a totally different story, for reasons Vader already touched on.

Beneath Keegan's hostility lies truth. Going by the general release date isn't much different than a film only coming to home video many years after release following -only- a limited release, then saying that's the year it came out. It's ridiculous. The first time it's shown by theaters after being bought is the official release date. This point is reinforced with marketing materials, most top ten lists, and the Academy Awards. Occasionally there's some dispute on this point with foreign films, but rarely ever with domestic releases.

Well, there's a difference between years and weeks, and home video releases and wide releases. I don't think it's a stretch to call it a 2013 release (though I don't personally think of it as such) when the large majority of people didn't see it until 2013. In the majority of places (outside of big cities), limited releases mean nothing.

Besides, it's Bacon's list. Why did everyone shove a stick up their own asses about it?
