Possible plot hole?

Everyone seems to forget that Wayne is a mentally scarred person. His thinking is strange. He fights crime because he blames himself for the death of his parents. He blamed himself for Dent's overall turn, which is why I think he made the decision he made.

OK, so they charge the Joker, then what? Bring him to trial on murder charges? The Joker is too smart to let that stand, and he'd expose the charges as lies.

It's too dangerous to try and frame the Joker. Pinning it on Batman is a whole lot easier. And safer. And Batman can take it anyway.

The Joker has no rights anymore after what he has done to Gotham.Just charge him for it and put him in jail until his dead.

Do you think he'll stay there? We've already seen he can get away from the jail. And, most of all, he has never denied his murders, it should be very weird if he denies just some of them, the people would start having some suspects...

Ummm, in America, people go to trial to defend themselves against charges that are brought against them. They can't just lock him up and throw away the key.

I know you don't live in America, but the constitution protects the Joker. He'd have a fair and speedy trial.

As others have pointed out, everyone in America has the right to a fair trial.

And as I pointed out, if they decided to remove this right from The Joker-then he has succeeded in turning the city of Gotham into a corrupt one.
